1. I am not a CH Member - what is happening to my pension plan?

Currently, the Company has said that it intends to continue their pension plans. On the basis of the information that we have received, we have no reason to think that the restructuring process will affect your pension benefits. All of the materials filed by Canwest state that the pension plans are to remain intact and Canwest will continue to administer them.

2. I am a CH Member - what is happening to my pension plan?

Both salaried and unionized retirees will be treated in the same way while the CH Employees Plan is in the process of being wound up. Canwest has advised that the plan is underfunded, but we do not yet have up-to-date information on the level of funding of the CH Pension Plan. Based on the information that we have, there is a right probability that your pension will be reduced. As this time, we do not know by how much your pension will be reduced.

3. I received post-retirement benefits. What now?

If you were a unionized employee on the date of your retirement, you will be classified as a unionized retiree and your post-retirement, non-pension benefits will be continued.

If you were a salaried, non-union employee on the date of your retirement, you will be classified as a salaried retiree and your post-retirement, non-pension benefits will cease as of November 30, 2009. After that date, you will not be eligible to receive health, dental, life insurance or other benefits. Each salaried retiree received notice of discontinuance of benefits along with a an assessment of the value of these benefits. As salaried retirees are unsecured creditors of Canwest, the value of your claim will be compromised by the Canwest restructuring. We do not have exact information at this point.

4. How was CHSMC appointed to represent me, and will this representation cost me?

The Ontario Superior Court of Justice appointed our firm to act on behalf of Canwest retirees in the restructuring process to ensure that the interests of the retirees are represented. By appointing one law firm to represent a group which share similar interests, the proceedings will be much more organized and efficient.

There will be no cost to you, as the Court has ordered the Company to pay for the legal representation of the retirees. It is a standard practice to provide funding for the benefit of former employees who would otherwise would have no legal representation.

However, you do have the choice to opt out of our representation.

5. What is happening in the Claims Process?

CHSMC has submitted modifiable claims on behalf of the Retirees, based on the information we have to date. Once we have sufficient information to value all of the claims, we will change the claims amounts, as appropriate, to properly reflect the value of the claims.
