Bill 76, which amends the Canada Elections Act, Passes Senate; Full Voting Rights for Expats Granted December 13

On December 11, 2018, the Senate passed Bill 76, which received  Royal Assent on December 13, 2018. Importantly, the legislation restores voting rights to ex-pat Canadians who have been out of the country for more than five years.

Cavalluzzo, led by former partner Shaun O'Brien and partner Amanda Darrach, has been advocating on behalf of ex-pat Canadians seeking this very change. Shaun and Amanda appeared at the Supreme Court of Canada in March 2018, arguing that this kind of voting rights restriction is unconstitutional. Though we are waiting for the Supreme Court's decision, this legislative change represents a victory for the firm's clients, Gillian Frank and Jamie Duong, and ex-pat Canadians around the world.
