When postal workers were legislated back to work in 2011 after being locked out by Canada Post, the Canadian Union of Postal Workers launched a constitutional challenge to the legislation. The Ontario Superior Court heard this challenge during the week of October 5, 2015.

This case presented the first occasion upon which a court has had the opportunity to deal with back to work legislation since the Supreme Court of Canada issued its decision confirming constitutional protection for the right to strike, in Saskatchewan Federation of Labour.

Paul Cavalluzzo and Adrienne Telford argued the case on behalf of the Canadian Union of Postal Workers. Below is a photograph from the Court hearings showing, from left to right, Cathy Kennedy (National Union Representative, CUPW), Adrienne Telford (Cavalluzzo LLP); Daniel Wilband (Articling Student, Cavalluzzo LLP), Geoff Bickerton (CUPW Research Director) and Paul Cavalluzzo (Cavalluzzo LLP).
