ONA commenced this action in 2006 against the Government of Ontario on behalf of union members who worked for municipalities or other employers providing home care services and who were transferred to a Community Care Access Centre ("CCAC") between 1996 and 1998. These members transferred their pensions to the Hospitals of Ontario Pension Plan from various plans (OMERS, VON, and the FSA plan). ONA alleged that the Government made a promise that members would suffer no loss in pension benefits as a result of the transfer, and did not keep the promise, causing losses to the class members.

On November 28, 2012, the Superior Court approved a settlement in this class action. The settlement provided for a claims process, which is now complete. The Court's decision to approve the settlement can be found here.

ONA and the class plaintiff, Dianne Leclair, were represented in this action by Stephen Moreau.
